⛔ Section 73 – Cancellation, Suspension, and Variation of Permit

(परमिट रद्द करना, निलंबित करना या उसमें बदलाव करना)

📜 Section 73 का उद्देश्य

Section 73 यह सुनिश्चित करता है कि:

✔️ Transport Vehicle Permit holder नियमों का पालन करे।
✔️ किसी भी violation, illegal activity या non-compliance की स्थिति में RTA / STA permit को:

  • Cancel (रद्द)
  • Suspend (निलंबित)
  • या Modify / Vary (बदल) सके

मतलब: यह section transport compliance और road safety को enforce करता है।

🔶 Section 73 – मुख्य प्रावधान

📌 1️⃣ Cancellation of Permit

RTA / STA permit cancel कर सकती है यदि:

  • Permit holder ने illegal operation किया
  • Overloading किया गया
  • Unauthorized route पर vehicle चला
  • False / misleading information दी गई
  • Court / Government द्वारा निर्देश

📌 2️⃣ Suspension of Permit

  • Temporary basis पर permit suspend किया जा सकता है
  • कारण: minor violation या investigation
  • Suspension अवधि पूरी होने पर permit restore किया जा सकता है

📌 3️⃣ Variation of Permit

  • Route, passenger / goods capacity या service timing में modification संभव
  • Variation तब होती है जब:
    • Public convenience या safety की जरूरत
    • Vehicle specification में बदलाव
    • Authority के निर्देश

📌 4️⃣ Procedure

  • Notice to permit holder
  • Opportunity of hearing
  • Written order of cancellation, suspension, or variation
  • Legal appeal possible (State Transport Appellate Tribunal)
