(कंपनियों द्वारा किए गए उल्लंघन पर प्रावधान)

📜 Section 87 का उद्देश्य

Section 87 यह सुनिश्चित करता है कि:

✔️ यदि कंपनी या firm / society द्वारा Motor Vehicles Act या rules का उल्लंघन किया जाता है,
✔️ तो कंपनी और उसके responsible officers दोनों पर legal liability लागू हो।

मतलब: सिर्फ company नहीं, बल्कि उसके directors / managers / authorized persons भी accountable होंगे।

🔶 Section 87 – मुख्य प्रावधान

📌 1️⃣ Corporate Liability

  • यदि कंपनी द्वारा:
    • Permit violation
    • Overloading
    • Unsafe operation
    • Route या safety violation
      किया जाता है, तो कंपनी itself liable होगी।

📌 2️⃣ Officers Liability

  • Company के directors, managers या authorized officers भी liable होंगे, अगर violation उनके control / consent / connivance में हुआ हो।
  • मतलब: अधिकारी जानबूझकर या negligently violation में शामिल हुए हों।

📌 3️⃣ Penalties / Punishments

  • Fine / penalty payable by company
  • Responsible officers पर personal liability भी
  • Suspension / cancellation of permit possible
