📜 Section 23 का उद्देश्य

Section 23 यह सुनिश्चित करता है कि:

  • Driving Licence नियमों का उल्लंघन करने वाले drivers को कानूनी दंड मिले।
  • Road safety बनी रहे और repeat offenders को penalize किया जा सके।
  • Licensing Authority के पास enforcement power हो।

यह section Traffic Rules और Licence Compliance का मुख्य legal आधार है।

🔶 Section 23 – मुख्य प्रावधान

📌 1. Offences under Licence Rules

Drivers को निम्नलिखित उल्लंघनों के लिए penalize किया जा सकता है:

  1. Driving without Licence – Licence न होने पर
  2. Expired Licence – समय सीमा समाप्त होने के बाद driving
  3. Learner Licence Rules Violation – supervision या vehicle type का उल्लंघन
  4. Driving with wrong vehicle category – जैसे LMV Licence से HMV चलाना
  5. Suspended / Cancelled / Disqualified Licence से driving
  6. Fake / Forged Licence Documents

उल्लंघन दंड / Penalty
Driving without Licence ₹5,000 fine (as per 2019 Amendment)
Expired Licence ₹1,000 – ₹5,000 fine
Learner Licence rules violation ₹500 – ₹2,000 fine
Wrong vehicle category ₹5,000 – ₹10,000 fine + licence suspension
Suspended / Cancelled / Disqualified Licence ₹10,000 fine + criminal liability
Fake / forged licence documents Imprisonment + fine

Note: Penalty amount state-wise और Amendment 2019 के अनुसार बदल सकता है।

📌 3. Additional Enforcement

  • Repeated violations पर licence suspension / cancellation।
  • RTO / Police के पास vehicle seizure और challan का अधिकार।
  • Offence record digital system (Parivahan / e-Challan) में maintain किया जाता है।
