🔷 संवैधानिक आधार (Constitutional Basis)

Drugs and Cosmetics Act, 1940 का आधार भारतीय संविधान के निम्न प्रावधानों में निहित है:

📌 अनुच्छेद 21

  • जीवन और स्वास्थ्य का अधिकार
  • Unsafe / fake medicines से सुरक्षा

📌 अनुच्छेद 47 (DPSP)

  • राज्य का कर्तव्य: जनता के स्वास्थ्य और पोषण की सुरक्षा

➡️ दवाओं और कॉस्मेटिक्स के सुरक्षित उपयोग और उपभोक्ता सुरक्षा हेतु यह कानून बनाया गया।

🔷 Drugs and Cosmetics Act, 1940 का उद्देश्य

  • दवा और कॉस्मेटिक्स की गुणवत्ता और सुरक्षा सुनिश्चित करना
  • नकली, मिलावटी और घटिया दवाओं को रोकना
  • Manufacturing, sale, import, distribution को regulate करना
  • Consumer / Patient health और सुरक्षा की रक्षा

⚖️ Product Fraud से संबंधित प्रमुख Sections

🟥 Section 18 – Manufacture of Drugs

  • Licensed manufacturer द्वारा ही दवा का निर्माण
  • Unlicensed या sub-standard drugs = अपराध

🟥 Section 21 – Adulterated Drugs

  • घटिया या मिलावटी दवाएं
  • Ingredients / expiry date छुपाना

🔴 सज़ा:

  • Up to 5 साल imprisonment + fine

🟥 Section 22 – Misbranded Drugs

  • Fake labels
  • Wrong composition
  • Misleading packaging

🔴 सज़ा:

  • ₹10,000 – ₹25,000 fine (repeat offender पर higher)

🟥 Section 23 – Manufacture or Sale of Drugs not of standard quality

  • Non-standard drugs बेचना
  • Unsafe medicines

🔴 सज़ा:

  • Imprisonment up to 6 months
  • Fine up to ₹5,000

🟥 Section 27 – Sale without license

  • Licensed pharmacy / retailer होना अनिवार्य
  • बिना license बेचने पर criminal liability

🟥 Section 27A – Cosmeceuticals & Cosmetics Fraud

  • Fake / unsafe cosmetics बेचने पर
  • Misbranded products

🟦 Regulatory Authority

  • Central Drugs Standard Control Organization (CDSCO)
  • State Drugs Controller
  • Inspectors / Licensing Authority

Powers:

  • Inspection
  • License cancellation
  • Product seizure
  • Legal action against manufacturer / seller

🟦 Online Sale & Product Fraud

  • E-pharmacy पर भी लागू
  • Fake / expired drugs = offence
  • Mandatory registration & license for online sale

  • Safe & genuine medicines लेने का अधिकार
  • Quality standards का right
  • Complaint करने का अधिकार (CDSCO / Drugs Controller / Consumer Commission)
