(अधिकारियों द्वारा अपराध पर कानूनी कार्रवाई की प्रक्रिया)

📜 Section 90 का उद्देश्य

Section 90 यह सुनिश्चित करता है कि:

✔️ Motor Vehicles Act और rules का उल्लंघन होने पर कौन-कौन से अधिकारी और अदालतें अपराध की कार्रवाई कर सकती हैं।
✔️ Law enforcement में clarity और legal procedure सुनिश्चित हो।

मतलब: नियम तोड़ने पर कौन केस कर सकता है और कौन तय करेगा कि कौन सा officer कार्रवाई करेगा, यह section स्पष्ट करता है।

🔶 Section 90 – मुख्य प्रावधान

📌 1️⃣ Who can take cognizance

  • Offences under Motor Vehicles Act केवल authorized officers द्वारा ही action में लिए जा सकते हैं।
  • Examples:
    • RTA / STA officers
    • Police officers empowered under the Act

  • Violation पर court / magistrate के पास legal powers
  • Minor violations के लिए Executive / authorized officers penalty impose कर सकते हैं
  • Serious offences के लिए judicial proceedings

  • Authorized officer violation की पहचान करता है
  • Notice / show-cause issue किया जाता है
  • Penalty / fine / prosecution initiate किया जाता है
  • Permit holder / driver / owner को legal hearing का मौका
