📜 Section 74 का उद्देश्य

Section 74 यह सुनिश्चित करता है कि:

✔️ Transport Vehicle Permit या related decisions में अन्याय या disagreement होने पर,
✔️ Permit holder या अन्य संबंधित व्यक्ति legal appeal कर सके।

मतलब: Transport Authority के decisions के खिलाफ समीक्षा और न्यायिक प्रक्रिया का प्रावधान।

🔶 Section 74 – मुख्य प्रावधान

📌 1️⃣ कौन अपील कर सकता है?

  • Permit holder
  • Applicant whose permit application was rejected
  • Vehicle owner / operator affected by RTA / STA order

📌 2️⃣ अपील कहाँ दर्ज होती है?

  • State Transport Appellate Tribunal (STAT) में
  • Tribunal decisions final नहीं, कुछ cases में High Court तक appeal संभव

📌 3️⃣ अपील की समय सीमा

  • आम तौर पर 30–60 days (State rules के अनुसार)
  • Delay होने पर extension संभव (Tribunal discretion)

📌 4️⃣ Tribunal के powers

  • Tribunal RTA / STA order को confirm, modify या cancel कर सकता है
  • Tribunal fair hearing के बाद निर्णय लेता है
  • Legal evidence और rules के अनुसार judgment देता है
