⚖️ Section 155 – Claims Tribunal / Procedure for Claim
📜 Section 155 का उद्देश्य
Section 155 यह सुनिश्चित करता है कि:
✔️ Accident victims को compensation पाने के लिए Tribunal में claim करने का statutory right मिले
✔️ Insurance companies, vehicle owners, और tribunals के बीच procedure clearly defined हो
मतलब: Accident का पैसा पाने के लिए victim को proper legal route available है।
🔶 Section 155 – मुख्य प्रावधान
📌 1️⃣ Claims Tribunal का Role
- Tribunal accident claims की सुनवाई करता है
- Tribunal को owner / insurer / victim सभी पक्षों को सुनना होगा
- Fast-track settlement possible
📌 2️⃣ Third Party Rights
- Third party directly Tribunal में claim कर सकता है
- Owner या driver की liability prove करना जरूरी नहीं (No-Fault principle)
📌 3️⃣ Insurance Company की Involvement
- Tribunal insurer को notice देगा
- Hearing में insurer अपनी दलील रख सकता है
- Payment directly insurer द्वारा Tribunal order के अनुसार किया जाएगा
📌 4️⃣ Time-bound Procedure
- Tribunal में filing के लिए maximum time limit prescribed
- Insurance company को payment करने का समय भी defined
📌 5️⃣ Adjustment with No-Fault Compensation
- Section 140–144 के तहत मिले amount से adjustment होगा
- Tribunal final award में इसे include करेगा
