🛒 E-commerce Rules, 2020 – Product Fraud Perspective

🔷 संवैधानिक आधार (Constitutional Basis)

E-commerce Rules, 2020 का आधार भारतीय संविधान के निम्न प्रावधानों में निहित है:

📌 अनुच्छेद 21

  • सुरक्षित उत्पाद और डिजिटल transactions में उपभोक्ता का जीवन और स्वास्थ्य सुरक्षित करना

📌 अनुच्छेद 38

  • सामाजिक और आर्थिक न्याय सुनिश्चित करना

📌 अनुच्छेद 39(a, b)

  • उपभोक्ताओं को समान और न्यायपूर्ण संसाधन प्रदान करना

➡️ ऑनलाइन धोखाधड़ी (Product Fraud) रोकने के लिए नियम बनाए गए।

🔷 E-commerce Rules, 2020 का उद्देश्य

  • Online marketplace में उपभोक्ता सुरक्षा सुनिश्चित करना
  • Product Fraud (fake, defective, misleading products) को रोकना
  • E-commerce platforms को regulated, accountable और transparent बनाना

⚖️ Product Fraud से जुड़े प्रमुख प्रावधान (Sections / Rules)

🔹 Rule 4 – Marketplace Liability

  • Marketplace provider जिम्मेदार है:
    • केवल verified sellers को allow करना
    • Seller की identity और address details maintain करना
    • Misleading / counterfeit product prevent करना

🔹 Rule 5 – Transparency & Consumer Rights

  • Product listing में सही info होनी चाहिए:
    • MRP / Price / Net Quantity
    • Expiry date / Manufacturing date
    • Country of origin
    • Refund / Replacement policy

➡️ Misrepresentation / false info = Product Fraud

🔹 Rule 6 – Redressal Mechanism

  • Marketplace में Grievance Officer appoint करना जरूरी
  • Consumer complaint resolve within 5–7 days
  • Serious fraud → CCPA / Consumer Court

🔹 Rule 7 – Prohibited Products

  • Fake / substandard / counterfeit / banned items online बेचने पर strict action
  • Examples:
    • Expired medicines / cosmetics
    • Counterfeit electronics
    • Adulterated food

🔹 Rule 8 – Monitoring & Reporting

  • Platforms को quarterly report submit करनी होगी:
    • Complaints received
    • Actions taken
    • Removed / blocked products

🔹 Rule 9 – Penalty & Enforcement

Violation Consequence
Misleading / fake product Fine + Product removal
Unsafe / banned product Penalty + Platform liable
Repeat offender Platform + Seller both liable
Non-compliance (reporting / grievance) ₹50,000 – ₹5,00,000 fine
