⚖️ Section 157 – Procedure for Insurance Claims and Payment by Insurer
📜 Section 157 का उद्देश्य
Section 157 यह सुनिश्चित करता है कि:
✔️ Accident claims की प्रक्रिया transparent और smooth हो
✔️ Insurance company timely payment करे
✔️ Accident victim को delay या dispute से राहत मिले
मतलब: Insurance claim का proper procedure statutory रूप से define किया गया है।
🔶 Section 157 – मुख्य प्रावधान
📌 1️⃣ Claim Filing Procedure
- Accident victim / third party
- Tribunal / Court में claim file कर सकता है
- Insurance company को notice देना अनिवार्य
📌 2️⃣ Insurer की Responsibility
- Tribunal / Court का order / award receive करने के बाद
- timely payment करना आवश्यक
- Payment directly victim को किया जाएगा
📌 3️⃣ Adjustment with No-Fault Compensation
- Section 140–144 के तहत मिले compensation से adjustment होगा
- Tribunal final award में इसे include करेगा
📌 4️⃣ Recovery Rights
- अगर insurer ने payment की
- और बाद में owner / driver दोषी पाए गए
- तो insurer paid amount owner / driver से recover कर सकता है
📌 5️⃣ Third Party Rights Safe
- Accident victim / third party की rights पर कोई असर नहीं
- Payment पहले उन्हें मिलेगी
- Owner / driver और insurer का dispute अलग
