💸 Section 153 – Recovery by Insurer

📜 Section 153 का उद्देश्य

Section 153 यह सुनिश्चित करता है कि:

✔️ अगर insurer ने third party को payment कर दिया
✔️ और accident में owner / driver की गलती साबित होती है
✔️ तो insurer paid amount को owner / driver से recover कर सके

मतलब: Insurer की financial liability cover हो जाती है, और accident victim को नुकसान नहीं होता।

🔶 Section 153 – मुख्य प्रावधान

📌 1️⃣ Recovery Right

• Insurer को अधिकार है कि
• paid compensation amount को vehicle owner / driver से वसूल करे
• यदि owner / driver की negligence साबित हो जाए

📌 2️⃣ Procedure

• Insurer owner / driver को notice देता है
• Legal procedure के तहत recovery करता है
• Tribunal / Court के involvement के अनुसार

📌 3️⃣ Third Party Rights Safe

• Third party को कोई फर्क नहीं पड़ता
• Payment उन्हें full मिलेगी
• Owner / driver और insurer का internal dispute अलग

📌 4️⃣ Limits and Conditions

• Recovery सिर्फ paid amount के लिए
• Interest / penalties applicable हो सकते हैं
• Insurer को proper legal documentation रखना होगा

• Insurer recover करते समय
• Third party rights पर कोई असर नहीं पड़ता
• Tribunal / Court protection available
