💰 Section 152 – Payment by Insurer

📜 Section 152 का उद्देश्य

Section 152 यह सुनिश्चित करता है कि:

✔️ Insurance company court / tribunal के award के अनुसार third party को payment करे
✔️ Accident victim को compensation delay या dispute से प्रभावित न हो

मतलब: Tribunal या court के judgment के तुरंत बाद insurer को पैसा देना ही होगा।

🔶 Section 152 – मुख्य प्रावधान

📌 1️⃣ Obligation of Insurer

• Tribunal / Court का award या settlement
• Insurer को time-bound payment करना अनिवार्य

📌 2️⃣ Priority to Third Party

• Accident victim / third party को पहले भुगतान किया जाएगा
• Vehicle owner / policy holder का recovery बाद में

📌 3️⃣ Payment Recovery Rights

• अगर insurer ने payment किया
• और बाद में owner / driver दोषी पाए गए
• तो insurer owner / driver से recovery कर सकता है

📌 4️⃣ No Delay Allowed

• Insurer delay नहीं कर सकता
• Payment न करने पर penalty / legal action हो सकती है

• Tribunal / Court decision binding
• Insurer के लिए primary duty बनी रहती है
• Owner / driver dispute के बावजूद payment unavoidable
