(नियम बनाने की शक्ति – State Government)
📜 Section 85 का उद्देश्य
Section 85 यह सुनिश्चित करता है कि:
✔️ State Government और Central Government को अधिकार हो कि वे Motor Vehicles Act के तहत rules और regulations बनाएँ।
✔️ Transport system का smooth functioning, safety और compliance सुनिश्चित हो।
मतलब: Vehicle permits, route control, passenger safety, goods carriage, hazardous vehicles आदि के लिए detailed rules बनाना legal रूप से possible है।
🔶 Section 85 – मुख्य प्रावधान
📌 1️⃣ Power to Make Rules
- State Government / Central Government द्वारा rules बनाए जा सकते हैं, जैसे:
- Vehicle classification
- Permit procedure
- Passenger / goods / hazardous vehicle safety norms
- Route licensing और fare structure
- Driver qualifications और training requirements
📌 2️⃣ Publication and Enforcement
- Rules Gazette में publish करने के बाद enforce किए जाते हैं
- Violation होने पर penalty, fine या legal action possible
📌 3️⃣ Delegation of Powers
- Government rules बनाने के बाद STA / RTA या authorized officers को enforce करने के लिए powers दे सकती है
📌 4️⃣ 2019 Amendment के बाद बदलाव
- Digital compliance, online permit, ride-sharing rules
- Environment-friendly vehicles और emission norms
- Transparency और faster enforcement
