❓ Product Fraud की रिपोर्ट करने की समय सीमा
Product Fraud के मामले में समय पर शिकायत करना बहुत जरूरी है। कानूनी रूप से समय सीमा complaint type और forum पर निर्भर करती है।
1️⃣ Consumer Forum / Consumer Court Complaint
- Time Limit: 2 साल
- काउंटिंग: तब से शुरू होती है जब उपभोक्ता को fraud या defect का पता चलता है
- Applicable Laws:
- Consumer Protection Act, 2019
- Example:
- अगर आपको fake या defective product मिला और 2 साल के अंदर Consumer Court में complaint दर्ज करें, तभी claim valid होगा
2️⃣ FIR / Police Complaint (Criminal Case)
- IPC और fraud के मामले में limitation अलग होती है
- General IPC sections (415, 420, 463, 468) में 3 साल की limitation होती है
- Dangerous / counterfeit product → तुरंत FIR करना best practice है
- Online / offline fraud दोनों में police complaint तुरंत करनी चाहिए
3️⃣ Online Platform / Grievance Officer Complaint
- Platform के internal grievance mechanism में 5–7 days में complaint resolve होना चाहिए
- Delay करने से internal refund / replacement process slow हो सकती है
- E-commerce Rules, 2020 के तहत platforms complaint receive करने और redressal करने के लिए bound हैं
Important Notes:
- Proof और communication record तुरंत सुरक्षित रखें
- Delay करने पर refund / replacement / compensation claim मुश्किल हो सकता है
- Serious fraud → FIR जल्द दर्ज करें ताकि criminal action possible हो
