उपभोक्ता Product Fraud की शिकायत कैसे कर सकता है?

यदि आपको नकली, defective, counterfeit या misleading product मिला है, तो आप निम्न तरीके से शिकायत दर्ज कर सकते हैं।

Step 1: Seller / Platform से संपर्क करें

  • Product issue को email, chat या customer care के जरिए बताएं
  • Refund / Replacement मांगें
  • सभी communication का record सुरक्षित रखें

Legal Basis:

  • Consumer Protection Act, 2019
  • E-commerce Rules, 2020

Step 2: Internal Grievance Redressal (Online Platforms)

  • सभी major marketplaces (Amazon, Flipkart, Myntra) का Grievance Officer
  • Complaint 5–7 दिन में resolve होना चाहिए
  • Record / complaint number सुरक्षित रखें

Step 3: Central Consumer Protection Authority (CCPA)

  • Serious या unresolved cases में CCPA को complaint करें

  • Submit complaint with:
    • Invoice / order details
    • Product photos / screenshots
    • Communication record
    • Seller / platform details

Step 4: Local Consumer Forum (Offline / Big Claims)

  • District Consumer Commission: ≤ ₹1 crore
  • State Consumer Commission: ₹1–10 crore
  • National Consumer Commission: > ₹10 crore
  • Attach: Invoice, photo, screenshots, communication record

Step 5: Police Complaint / FIR (Criminal Cases)

  • Product dangerous, counterfeit या harmful हो → FIR दर्ज करें
  • Applicable IPC Sections: 415, 420, 463, 468
  • Medicines / food → Drugs Act, FSSAI Act भी applicable

Step 6: Follow-up & Legal Action

  • Platform / CCPA / Consumer Court के साथ timely follow-up करें
  • Refund / Replacement / Compensation प्राप्त करें
  • Legal orders और product evidence संभाल कर रखें
