🚗 Section 40 – Registration, Where to Be Made

(वाहन का पंजीकरण कहाँ किया जाएगा)

📜 Section 40 का उद्देश्य

Section 40 यह तय करता है कि:

✔️ किसी Motor Vehicle का Registration किस Registering Authority (RTO) के पास किया जाएगा
✔️ Registration का आधार Vehicle Owner का Address होगा
✔️ पूरे देश में एक uniform registration system बना रहे

🔶 Section 40 – मुख्य कानूनी प्रावधान

📌 1. Registration कहाँ होगा?

Motor Vehicle का Registration किया जाएगा:

👉 उस Registering Authority (RTO) के पास
जहाँ—

• Vehicle Owner सामान्य रूप से रहता है (Ordinarily Resides)
• या
• Vehicle Owner का Place of Business स्थित है

📌 2. Individual Owner के लिए

यदि Vehicle Owner एक व्यक्ति (Individual) है:

• तो Registration:
  ✔️ उसके Permanent Address
  ✔️ या जहाँ वह आमतौर पर रहता है

वाले क्षेत्र के RTO में होगा।

📌 3. Company / Firm के लिए

यदि Vehicle Owner:

• Company
• Firm
• Trust
• Institution

है, तो Registration:

✔️ उस स्थान के RTO में होगा
जहाँ उसका Registered Office / Business Place स्थित है।

📌 4. गलत RTO में Registration नहीं

❌ किसी अन्य RTO में Registration कराना
❌ सिर्फ सुविधा या fancy number के लिए

Section 40 के खिलाफ माना जाएगा।
