🚗 Section 49 – Records of Registration

(वाहन पंजीकरण का रिकॉर्ड रखना)

📜 Section 49 का उद्देश्य

Section 49 यह सुनिश्चित करता है कि:

✔️ सभी Registered Vehicles के record / entries RTO / Registering Authority के पास सुरक्षित और maintained रहें
✔️ Vehicle ownership, transfer, cancellation, suspension, hypothecation आदि की पूरी जानकारी systematic तरीके से उपलब्ध हो
✔️ Road safety, taxation, law enforcement और insurance compliance आसान हो

उद्देश्य: Transport transparency और Vehicle tracking को सुनिश्चित करना।

🔶 Section 49 – मुख्य प्रावधान

📌 1. Record किस प्रकार रखा जाएगा?

• Registering Authority vehicle के सभी विवरण maintain करेगी, जैसे:
  • Owner का नाम और पता
  • Vehicle details (Make, Model, Engine, Chassis)
  • Registration Number
  • Hypothecation / loan details
  • Transfer / Sale / Cancellation history

📌 2. Maintenance Period

• Record हमेशा current और historical दोनों रूप में रखा जाएगा
• Authority के पास legal compliance और audit के लिए उपलब्ध होना चाहिए

📌 3. Inspection और Verification

• Traffic Police, RTO officers या Courts के पास रिकॉर्ड verify करने का अधिकार
• Owner को भी अपने record की copy लेने का अधिकार

📌 4. Digital / Online Records

• Motor Vehicles (Amendment) Act, 2019 के बाद:
  • Parivahan portal और DigiLocker में डिजिटल रिकॉर्ड mandatory
  • Fraud, duplicate RC और fake registration पर strict control

📌 5. Legal Effect

• Registered records vehicle की legal identity का प्रमाण हैं
• Accident, insurance claim और law enforcement में binding
