🚗 Section 55 – Recording or Removal of Hypothecation in Registration Certificate (RC)
(RC में Hypothecation / Loan की जानकारी दर्ज करना या हटाना)
📜 Section 55 का उद्देश्य
Section 55 यह सुनिश्चित करता है कि:
✔️ यदि वाहन loan / finance / hypothecation पर है, तो RC में financier का नाम और loan details दर्ज हों।
✔️ जब loan पूरी तरह चुका दिया जाए, तो RC में hypothecation हटाई जा सके।
उद्देश्य: Vehicle ownership और financer की legal clarity बनाए रखना, fraud और disputes रोकना।
🔶 Section 55 – मुख्य प्रावधान
📌 1. Hypothecation Entry कब की जाती है?
- Vehicle loan / finance पर खरीदा गया हो
- Bank / financial institution के interest को RC में दर्ज किया जाता है
📌 2. Removal of Hypothecation
- Loan पूरा होने पर owner / financer apply कर सकते हैं
- RTO / Registering Authority RC से hypothecation entry remove करेगी
- Updated RC जारी होगा
📌 3. Required Documents
- Loan closure certificate / NOC from financer
- Identity proof
- Original RC
- Applicable fee
📌 4. Legal Effect
- RC में hypothecation entry होने पर financer का interest legally valid होगा
- Entry remove होने के बाद vehicle free of encumbrance माना जाएगा
- Sale / transfer / gift के समय RC में updated hypothecation status जरूरी
📌 5. Digital / Online Process
- Motor Vehicles (Amendment) Act, 2019 के बाद:
- Online update via Parivahan portal
- Faster verification और transparency
- Fraud prevention
