🔷 संवैधानिक आधार (Constitutional Basis)

Consumer Protection Act, 2019 का आधार
👉 भारतीय संविधान के निम्नलिखित प्रावधानों में निहित है:

📌 अनुच्छेद 38

• राज्य सामाजिक और आर्थिक न्याय सुनिश्चित करेगा

📌 अनुच्छेद 39(b)

• संसाधनों का समान और न्यायपूर्ण वितरण

📌 अनुच्छेद 21

• जीवन और स्वास्थ्य का अधिकार
  (Unsafe / fake products से सुरक्षा)

➡️ इसी संवैधानिक भावना के तहत
उपभोक्ताओं को धोखाधड़ी से बचाने के लिए यह कानून बनाया गया।

🔷 Consumer Protection Act, 2019 का उद्देश्य

• उपभोक्ता को नकली और दोषपूर्ण उत्पादों से सुरक्षा
• Misleading Advertisement पर रोक
• Fast और effective grievance redressal
• E-commerce regulation

🧾 Product Fraud से संबंधित प्रमुख कानूनी प्रावधान (Sections)

🟢 Section 2(10) – Defective Goods

यदि उत्पाद में:

• Quality
• Quantity
• Purity
• Standard

में कमी हो ➝ Product Fraud माना जाएगा।

🟢 Section 2(28) – Misleading Advertisement

गलत या झूठा प्रचार:

• झूठे claims
• False guarantee
• Fake endorsements

➡️ Product Fraud का सीधा मामला।

🟢 Section 2(34) – Product Liability

यदि:

• Product defective हो
• Consumer को नुकसान पहुँचे

तो जिम्मेदारी होगी:

• Manufacturer
• Seller
• Service Provider

🟢 Section 83–87 – Product Liability Action

Product Liability में शामिल:

• Physical injury
• Mental harassment
• Property damage

➡️ Consumer compensation मांग सकता है।

🟢 Section 89 – Misleading Advertisement पर सज़ा

अपराध	सज़ा
पहली बार	₹10 लाख तक जुर्माना
Repeat offence	₹50 लाख + ban

🟢 Section 94 – Recall of Products

Central Consumer Protection Authority (CCPA) को अधिकार:

• Fake product recall
• Refund आदेश
• Advertisement ban

🟢 Section 20 – Central Consumer Protection Authority (CCPA)

CCPA के powers:

• Investigation
• Search & seizure
• Penalty impose करना

➡️ Product Fraud मामलों में सबसे शक्तिशाली authority।

🟢 Section 21 – Misleading Ads पर रोक

• Celebrity endorsements भी liable
• False advertisement पर ban
