🔹 Section 170 का परिचय
Motor Vehicles Act, 1988 की धारा 170 (Section 170) बीमा कंपनी (Insurance Company / Insurer) के अधिकारों से संबंधित है।
यह धारा MACT को यह शक्ति देती है कि विशेष परिस्थितियों में बीमाकर्ता को सभी आधारों पर दावा विवाद (Contest the Claim on All Grounds) करने की अनुमति दी जा सके।
सामान्यतः Insurance Company के अधिकार सीमित होते हैं, लेकिन Section 170 में exception प्रदान किया गया है।
🎯 धारा 170 का उद्देश्य
Section 170 का मुख्य उद्देश्य है:
- धोखाधड़ी (Fraud) को रोकना
- Claimant और Owner/Driver के बीच collusion से बचाव
- Insurance Company के हितों की सुरक्षा
⚖️ सामान्य नियम (Normal Rule)
आम तौर पर Insurance Company केवल वही बचाव (Defences) ले सकती है जो:
- Section 149(2) में दिए गए हों
जैसे: - Policy breach
- Driving licence का अभाव
- Permit / Fitness violation
👉 Insurance Company negligence या compensation amount पर सीधे बहस नहीं कर सकती।
🚨 Section 170 के तहत अपवाद (Exception)
यदि MACT यह संतुष्ट हो जाए कि:
- Owner या Driver ने claim को contest नहीं किया, या
- Owner/Driver और Claimant के बीच collusion (मिलभगत) है
👉 तब MACT लिखित आदेश (Written Order) द्वारा:
- Insurance Company को
- Owner/Driver की तरह सभी आधारों पर claim contest करने की अनुमति दे सकता है
📌 इसे ही “Leave under Section 170” कहा जाता है।
📝 Section 170 की कानूनी प्रक्रिया
- Insurance Company को Application देनी होती है
- Tribunal को reasons record करने होते हैं
- बिना आदेश के Insurer को full contest की अनुमति नहीं मानी जाती

- Insurance Company को negligence, quantum of compensation, और liability पर बहस करने का अधिकार
- Appeal (Section 173) में भी Insurer को व्यापक अधिकार
- Fraudulent claims पर प्रभावी नियंत्रण
🔗 Section 170 और Section 173 का संबंध
यदि:
- Section 170 की अनुमति दी गई है
तो: - Insurance Company Award के खिलाफ Appeal दायर कर सकती है
- अन्यथा appeal के अधिकार सीमित रहते हैं
