⚖️ Section 164 – Protection of Persons Making Payment under Section 161 or 162

📜 Section 164 का उद्देश्य

Section 164 यह सुनिश्चित करता है कि:

✔️ जो भी व्यक्ति Section 161 (provisional payment) या Section 162 (payment to legal heirs/claimants) के तहत भुगतान करता है,
✔️ उसे legal proceedings या liability से सुरक्षित रखा जाए

मतलब: जो भी accident में victim को जल्दी राहत देने के लिए पैसा देता है, वह बाद में legal action से परेशान नहीं होगा।

🔶 Section 164 – मुख्य प्रावधान

📌 1️⃣ Persons Covered

• Insurance company
• Vehicle owner
• Authorized person making payment

📌 2️⃣ Protection from Liability

• Payment करने वाले को
• Tribunal / Court या अन्य legal proceedings में liability से बचाया जाएगा
• Good faith में किया गया भुगतान fully protected

📌 3️⃣ Adjustment with Tribunal Award

• Payment provisional या direct भी हो
• Tribunal / Court के final award में adjust किया जाएगा
• किसी भी तरह की double liability नहीं होगी
