🚦 Section 28 – Penalty for Driving without Licence / Learner Licence Rules
(बिना ड्राइविंग लाइसेंस या Learner Licence नियमों का उल्लंघन करने पर दंड)
📜 Section 28 का उद्देश्य
Section 28 यह सुनिश्चित करता है कि:
- कोई भी व्यक्ति बिना Driving Licence वाहन न चलाए।
- Learner Licence holders नियमों का पालन करें।
- Road safety सुनिश्चित हो और accidents / violations कम हों।
यह section Section 23 के supplement के रूप में लागू होता है, और enforcement के लिए strict penalties देता है।
🔶 Section 28 – मुख्य प्रावधान
📌 1. Driving without Licence
- किसी भी प्रकार का Motor Vehicle चलाना बिना valid licence अपराध है।
- Learner Licence holder केवल supervision में ही vehicle चला सकता है।
- Licence के category के बाहर वाहन चलाना भी illegal है।
📌 2. Learner Licence Rules Violation
- Learner Licence holders को supervision और restricted vehicle type का पालन करना अनिवार्य।
- Violation होने पर penalty लागू होती है।
- Example: LMV learner driving HMV vehicle, या unsupervised driving।

📌 4. Enforcement
- Police / RTO / DTO के पास vehicle seizure और challan करने का अधिकार।
- Digital tracking (Parivahan / e-Challan portal) के माध्यम से records maintain।
- Repeat offenders के लिए licence cancellation या criminal liability भी।
